Thank you for choosing “Paradise Match.com, LLC” (PM) serving as ”Operator” of a near all inclusive vacation package. To ensure that you understand the conditions of your particular vacation, please read the following policies and procedures completely.
All guests of ParadiseMatch.com must acknowledge and agree to the Terms and Conditions as part of their registration. All policies and procedures are subject to change at any time in PM’s sole discretion without notice.
I. BOOKING/PAYMENTS
Full payment with a credit card through our safeguard merchant account or bank wire is required to make a reservation. Some weeks, based on time of reservation, may require a non-refundable or partially non-refundable payment. A surcharge may apply for bookings made over the phone to PM’s reservation center instead of booking electronically. Separate payment policies may apply to holiday or special event departures if offered. Please email your questions to This email address is being protected from spambots. You need JavaScript enabled to view it..”>info@paradisematch.com. PM reserves the right to reinvoice your reservation should an error be made in computing your vacation price. Rates are subject to change including, but not limited to, increases in or establishments of surcharges, applicable taxes, government fees, and villa prices.
Late Booking Fee: If a booking/payment is taken or received when documents can no longer be issued via first class mail, a fee will be charged for alternative delivery service. E-Travel documents are not subject to late booking fees and are the preferred method of delivery.
Villa Taxes and Service Fee: PM books villas/features, where PM collects the full amount from you in advance and manages the payments to the villa/feature on your behalf. The booking is made by PM on the customer’s behalf and includes two components to the reservation: amounts being paid by PM to the villa/feature on customer’s behalf as well as compensation for services retained by PM. In connection with facilitating your villa, the amount you are charged will include tax recovery charges and service fees. This amount includes an estimate to recover the amount we pay to the villa related to your reservation for taxes owed by the villa including, without limitation, sales and use tax, occupancy tax, room tax, excise tax, value added tax, goods and services tax, and/or other similar taxes. The amount paid to the villa in connection with your reservation for taxes may vary from the amount we estimate and include in the amount charged to you. The amount charged to you also includes an amount to compensate PM for services in connection with the handling of your reservation.
PM is not the vendor collecting and remitting taxes to the applicable taxing authorities. Villas, as vendors, include all applicable taxes in the amount billed to PM and PM pays over such amounts directly to the vendors. PM is not a co-vendor associated with the vendor with whom PM books or reserves customer’s travel arrangements. Taxability and the appropriate tax rate and the type of applicable taxes may vary greatly by location. Guests will not be assessed any additional fees relating to taxes. PM is responsible for the USVI Gross Receipts tax as well.
Travel Protection Options: It is suggested that all guests purchase Travel Insurance through Travel Guard or other companies offering similar services. PM is not responsible for Travel related delays or cancellations affecting guests.
II. CANCELLATION/REFUNDS
If your plans change, your right to a refund is limited. A written refund request (subject to the penalties herein) must be submitted to PM no less than 90 days prior to the scheduled departure date. NO refund is available unless total paid guests for the week in question is equal to 12 or more and then only a 50% refund is entitled. The non-refunded balance may be applied towards a future vacation week (with no other discount available) if scheduled for and attended within six months of cancellation. Cancellations made within 90 days of scheduled departure receive no refund unless total guests exceed 16 for that week and then only a 50% of cost will apply. Full payment for rescheduled week must accompany new reservation, less the 50% value.
Should a guest decide to leave prior to the end of the vacation week, no refund will be forthcoming, and the Guest is responsible for any costs relating to this departure. ParadiseMatch.com will deliver the guest to point of departure (ferry dock, airport, etc.) as a courtesy at no additional charge.
For guests who wish to cancel within the penalty periods and can provide another paying guest (of the same sex) for the same vacation, you may be entitled to a full refund, less a reservation revision fee ($500) and any applicable fees that may result in the event of the substitution. (Such refund shall be made within 30 days of substitution). Opposite sex substitutions may be allowed on a case by case basis.
Your travel agent, or you personally, must request any refunds by sending a written request (emails are accepted) to PM at the time of a telephone cancellation or revision. No refunds will be made for missed or unused flights or most features. If you accept a refund, you waive all other rights and remedies under applicable law. III. IMPORTANT NOTICE REGARDING PASSPORT REQUIREMENTS FOR INTERNATIONAL TRAVEL
All travelers must present a valid, non-expired government issued passport for the British Virgin Island Customs and Immigration and for U.S. Customs re-entry after air, land or sea travel. For more information please visit the State Department’s consular website www.travel.state.gov or the U.S. Department of Homeland Security’s website www.dhs.gov. Please consult your travel agent or the Destination Consulate for further information. It is the traveler’s responsibility to provide proper documentation. Married or divorced women traveling under names other than what is printed on their travel documents must supply a marriage license and/or divorce decree. Foreign travelers, visit your local consulate for travel requirements (VISA or other written verification).
Baggage Limitations and Claims: Baggage limitations vary by carrier. Many airlines impose additional charges for checked luggage which is collected by the airline at check-in. PM will not cover any charges, loss or damage to any luggage or carry-on bags while guest is on plane or at airport. All claims for loss and damage to luggage must be handled by the air carrier at the airport, subject to any requirements and time limits set by U.S. law for domestic flights and the applicable Convention for international flights. The airlines do not accept responsibility for items such as soft-sided luggage, fragile or perishable items. Carry-on baggage may be limited, please check with airline.
IV. RESPONSIBILITIES
Guest Responsibilities: Guests must examine all information to ensure accuracy and call to verify flight times prior to departure. Guest rights and remedies set forth herein are in addition to any other rights and remedies under applicable law, but if you agree to a refund, you waive all other remedies.
Due to the fact that PM sells leisure vacations for travelers originating in the U.S., individuals attending a convention or those not originating from the U.S. may not use this product for their villa stay. If this vacation is used for any reason other than leisure travel originating in the U.S., some villas may directly assess an additional surcharge during holiday, convention, special event time periods or for non-U.S. originating travelers. Unless you file any claim you may have with PM within 30 days after the termination of this trip, all parties are released from further liability.
Guests agree that they are not permitted to invite or bring to any villa anyone not affiliated with or a guest of PM. Violators will be subject to dismissal from the villa and the remaining activities in that week. Guests are not required to stay overnight at their designated villa or attend all functions and activities, but must inform PM of their whereabouts and coordinate plans for their return and future involvement in the group’s activities.
Guests who abuse the amenities or cause grievous harm to facilities or persons (as determined by PM) may be asked to leave with no guest recourse and no return of any funds paid. Alcohol will be available all day and night and all guests assume full responsibility for their behavior, actions and the results thereof while under the influence of alcohol, or otherwise, with no responsibility, financial or otherwise, attributed to PM or its employees, subcontractors, and associated individuals or businesses.
No illegal drugs of any kind are permitted during any and all holiday weeks and PM bears no responsibility for any damage or legal action that may occur as a result of drug use or possession. Immediate dismissal may be enacted if drug use is detected by any guest.
ParadiseMatch.com Responsibilities: The operation of vacation packages is being conducted pursuant to Part 380 of the DOT’s Charter Regulations. PM is responsible to guests for making all arrangements for transportation (excluding all arrangements related to air or other means of travel that guest utilizes to arrive on site), accommodations and services offered, provided that in the absence of gross negligence on the part of PM, PM’s responsibility does not extend to any liability for personal injury or property damage arising out of or caused by any negligent act or omission on the part of any direct air carrier, villa or yacht operator, ground transportation contractor, optional tour operator/attendant or any person rendering any services being offered. PM is not responsible for any changes made by scheduled air carriers which are beyond PM’s control. This includes, but is not limited to, routing changes, aircraft equipment changes, flight cancellations or any changes to flight schedule. PM is not responsible for damage, delay or vacations affected by weather or other force majeure events beyond the control of PM. In no event shall any party be liable for consequential damages.
PM reserves the right to substitute villa accommodations and to make alterations in the itinerary which do not constitute a major change, if necessary, due to circumstances beyond the control of PM. Special requests such as room location, bedding, special meals or assistance will be communicated to the appropriate party, but cannot be guaranteed by PM. Items not included in your vacation price include, but are not limited to, villa specific service fees, resort fees, currency surcharges, baggage handling, rollaway beds, and other incidental fees such as personal item shopping charges, parking and phone calls and are payable directly to the villa or PM depending on the situation. Specials may be withdrawn at any time. Rates are based on availability.
Guests who select double occupancy status understand that if they are not satisfied with their assigned roommate, all efforts will be made to accommodate a request for making a change but PM cannot guarantee an arrangement will be made.
V. Dating and Matchmaking
It is understood that PM offers no guarantee that guests will find love, romance, partners or other relationships of any kind while on one of PM’s vacation weeks. While best efforts are applied to placing guests on a trip and in villas together based on compatibility and age parameters, no assurances of any kind are implied or stated herein.
No means No! PM is not responsible for any actions on behalf of any guest, male or female, whether acting singularly or interacting with another guest. Please respect the wishes of your fellow guests.
PM will perform on a best efforts basis to accept as close to an even number of men and women for all vacation weeks. However, PM reserves the right to modify this goal by accepting the following ratios between the sexes: up to twelve total guests may result in no less than a difference of 2, i.e. 7 men/women, 5 women/men, or 6 /4 for ten. (Eight total guests will have a 4/4 ratio and nine will have 5/4 and eleven will have 6/5, unless waived, see below.) Up to 18 total guests may result in no less than a difference of 3, and 18 or above a difference of 4 is permissible.
If paid guests fall outside of these parameters approximately 45 days prior to arrival date, guests of the majority sex will be notified to determine if they still want to attend or waive this condition. All guests will be notified no less than 30 days prior to arrival date with the option to cancel should the ratio remain outside of the parameters. Guests may waive this condition and agree to attend, or they may cancel for a full refund, less a $500 processing and villa fee per guest. It is hereby agreed that a cancellation by a guest within 90 days of arrival that causes the ratio rule to be violated, does not put this rule into effect, though all guests will be notified within 60 days of arrival. Should a week be cancelled, no further refund or payment, including airfare, is due guest.
VI. OTHER
Itinerary: Your vacation as set forth in PM’s flyers, brochures and website includes the following which form this contract: effective dates; origin and destination of activities; price of each vacation; lodging in villas, length of stay at each and other ground and boating accommodations and services.
Important Notice: ParadiseMatch.com, LLC, its employees, officers, directors and shareholders (collectively, “PM”) does not own, control or operate any villa or any air, land or water transportation vehicles or companies of any kind, including without limitation, airplanes, helicopters, boats, rental cars, ground transportation vehicles, transport companies, shuttle services, buses, or local tour companies which may offer excursions or tours. PM occasionally enters into contracts with villas and air, land or water transportation companies, but all such entities are owned and operated by independent contractors. PM is not responsible for any negligent or willful act, omission or failure to act on the part of any such entity or its employees, or of any other third party beyond its direct control. The PM name and logo may appear on posted or hand-held signs at your villa, at the airport of your departure or destination, in vans, buses, coaches or elsewhere during your vacation. This use of the PM name and logo is solely intended to help you identify persons or entities who might provide services to you during your trip, but does not indicate, and should not be understood by you to indicate that PM owns, controls or operates any entity displaying such a sign, or that PM employs or controls any person holding or displaying such a sign.
Emergency Medical Airlift Insurance: Offered at no additional charge during our Senior Weeks for all Guests 55 years and older with either MASA or SkyMed. Guests must fill out an application form at least two weeks prior to arrival to insure receipt of such insurance. All guests 62 years and older must provide a letter from their primary physician stating that their health is such that will not restrict their ability to travel and attend activities that involve yachts, planes, helicopters and water sports including but not limited to snorkeling, scuba, paddle boarding and swimming.
Medical conditions and the care of such conditions, are the responsibility of the Guest and PM is not liable for any situation arising from such a condition. All costs involving any services, including doctors, ambulances, etc. that may occur, are the full responsibility of the Guest(s) involved. A local physician is available for consultation on a case by case basis (at Guest cost) but is not an employee of PM nor does PM make any representation of the service or qualifications of such a physician or medical professional.
Photographs and Videos: Rooms, yachts and other feature photographs shown in promotions and on the web site are for informational purposes only and may not depict the actual villa/feature in which you will be staying or utilizing.
All photographs and videos taken by PM during your vacation are the exclusive property of PM and may be used in promotional and marketing venues at no cost or obligation to any and all Guests depicted in such photographs. All care and respect as to the nature of such photographs and videos will be taken. Guests may request that certain photographs not be used at the time the photo is taken. Guests may also request prior to arrival that no photographs or videos of that guest may be used by PM. Group photos are excluded from this request unless the guest chooses not to be photographed as part of the group.
Maps: The maps in brochure/flyers/postcards and on our website represent approximate locations and attractions and are not meant to be exact in every detail.
Applicable Law: It is agreed by and between you and PM that all disputes and matters whatsoever arising under or in connection with or incident to these policies and procedures shall be interpreted and litigated, if at all, in and before a court located in the United States Virgin Islands, U.S.A., to the exclusion of the courts of any other state or country. PM is an United States Virgin Island Limited Liability Corporation operating under the Trade Name ParadiseMatch.com and is licensed in the US Virgin Islands as a Tour Broker permitted to offer services described and discussed herein.
